Protection against gender discrimination in Bosnia and Herzegovina (BiH) displays several specific features. These are related to the creation of the BiH Constitution (drafted as part of the peace treaty), the direct application of the European Convention on Human Rights and its special position in the legal hierarchy of BiH. This study presents such special characteristics as well as many individual questions in connection with the scope of protection against gender-specific discrimination, taking into account the ruling practice of the Constitutional Court of Bosnia and Herzegovina, the ruling practice of the European Court of Human Rights and, to some extent, the ruling practice of German courts and related literature. Both the procedural dimension and the deficiencies in the protection against gender discrimination in Bosnia and Herzegovina are also addressed.
