Prostitution and its interactions with society has often been in the past and is still a magnifying glass for the relationship between sexuality, morality, and freedom of their respective times. The understanding, development, and evaluation of this phenomenon is examined in this work from a legal-criminological perspective.
In the first part, prostitution is defined comprehensively in order to distinct prostitution and respective actions from other sexual actions. Thereby, a particular focus is on peripheral areas such as striptease, telephone sex, or pornography. However, considering the historical context and development is important when examining and evaluating sexual actions in general and prostitution in particular. Historical ideas and perspectives still influence how prostitution and sexuality is recognized today. Therefore, the second part of this work presents the historical and legal development of prostitution from the ancient world to the present age and critically assesses the historical literature. This is followed by an empirical study in the third part in which participants rated whether they view different actions either as prostitution or not, whether they view prostitution as contra bonos mores, and whether they ever utilized prostitution. In the fourth and last part of this work, the findings in insights of the first three parts are combined and further evaluated. Thereby, the discrepancies between media reporting, legislation, and jurisprudence are illustrated through several examples. Furthermore, the present developments in criminal law are critically assessed and suggestions concerning future legislative and social handling of prostitution are proposed. Those center around regulations in the Prostitutes Protection Act as well as the criminal law concerning prostitution.
