About this book deutschenglish
This book offers a detailed comparative analysis of the doctrine of contract frustration and contract adjustment in the German law of obligations and the respective legal concepts codified in the Iranian Civil Code, the UN Convention on Contracts for the International Sale of Goods and the UNIDROIT Principles. It starts with a detailed examination of section 313 of the German Civil Code and goes on to address the problem of changed contractual circumstances in the above mentioned instruments of international law. After a brief overview of the basic features of the Iranian civil law system, the thesis tackles the issue of changed contractual circumstances under the current legal framework in Iran. This is followed by an analysis of the doctrine of contract frustration and contract adjustment in the light of several landmark cases. Finally, it discusses the advantages and disadvantages of the current legal situation under each respective legal system.
