This comparative law study deal with one of the fundamental principles of criminal law namely with the principle of legality (nullum crimen, nulla poena sine lege) and its related principles non-retroactivity (lex praevia), principle of certainty (lex certa), prohibition of analogy (lex stricta), prohibition of application of customary law (lex scripta). The purpose of this book is to analyse the application of rule of law (legality principle) in Turkey and Germany and to find out whether the strict and/or relative obedience of this rule in those countries help to establish a well-structured justice system and enable to have fair trials and exactly calculated fair end-punishments. The compatibility of legality principle with the use of uncertain terms used in penal code has been debated in detail.
