The transferability of rights is one of the central problems of legislation. In modern Europe, a developement towards an unrestricted fungibility of rights can be observed. Through the so-called liberation of land, the property market replaced the allocation of land by the monarchs. While the transferability of rights of property was thus acknowledged in Europe in the beginning of the 19th century, the fungibility of personal rights was heavily disputed. Such a right is the exclusive right of copying and distributing the opus concerned, the so-called right of publishing. The author researches the discussions over the transferability of the right of publishing from the founding of the German Confederation to the expiry of § 28 of the law of the right of publishing in 2002.
