Competition in Germany has become extreme in recent years due to the increased focus and intensity by providers of goods and services vying to claim the top position in their respective markets. At the same time, legal protections for damage to reputation remain unclear and there are numerous unsolved questions in this area. With this environment as a backdrop, the work examines the legal remedies available for the protection of commercial reputation against damage and criticism in a competitive market. The work analyzes how German law provides special statutory protection of reputation under the German Trademark Act and the German Act Against Unfair Competitionas well as analyzing how the different provisions of both Acts relate to each other. The aim was to assess whether the special statutory protection of reputation, as it is currently regulated in the German Trademark Act and the German Act Against Unfair Competition, is efficient and how such protection could be improved if necessary.Keywords
