Which food products are affected by mandatory indication of the country of origin throughout the EU? How did the European Court of Justice decide in the Judgment C-485/18 „Groupe Lactalis" regarding the admissibility of compulsory „country of origin labeling (COOL)“of milk, which was introduced in France?
The European Parliament has repeatedly discussed an extension of the obligatory indication of origin of food products. However, after the Commission ultimately declined this demand, some member states decided to take charge of the situation themselves by adopting national regulations. The aim was to support regional products. However, these national provisions could compromise the European single market, wherefore they are threatened of being repealed.
Anyway, it is a matter of fact that the origin of food is gaining significance. Consumers increasingly demand transparency in food industry in order to select products according to their origin. In this regard, local products are generally favored over foreign ones as the former are considered more eco-friendly and support local farmers. By observing further development of the legal situation in the EU and ist member states, the trend towards regional products becomes clear as well. The area of food law is nowadays largely regulated by EU law. Thus, the European food law plays a crucial role in establishing the basic conditions. On that account, the present work offers a broad view into the EU food law, whereby the Food Information Regulation No. 1169/2011 will be subject of particular examination.
The author is analyzing current developments and present regulations. Besides, another fundamental research issue is the conformity of an extension of the labelling of the country of origin with EU law. The book is both addressed to experts as well as fairly accessible by laymen.
