[...] David Brosende gelingt eine ausgewogene Darstellung, deren Lektüre sich nicht zuletzt wegen der durchaus kritischen Herangehensweise lohnt. Das Spannungsverhältnis zwischen Individualrechtsschutz und effizienter Gerichtsbarkeit lässt sich zwar kaum auflösen und wird die Vorgangsweise des EGMR daher sicher weiter prägen. Wie dieses Werk zeigt, lohnt es sich aber allemal, deren Legitimation kritisch zu hinterfragen.

This study is devoted to the procedural law of the European Convention on Human Rights (ECHR). It explores the question of whether judicial law-making in the procedural law of the ECHR, which is not based on the text of the treaty, has sufficient legitimacy.

The starting point of the question is the increasing workload of the ECtHR at the end of the 1990s and the constant improvement due to numerous procedural changes. These are based not only on Protocol No. 14 ratified by the Convention States, but also – in the absence of a willingness to reform on the part of the Convention States – on the development of innovative procedural instruments (e.g. the pilot judgment procedure) by the ECtHR itself.

The study examines procedural instruments developed by the ECtHR to speed up proceedings. It offers an analytical overview oriented to the question of sufficient legitimacy. In doing so, the study also addresses the question of whether the ECtHR's jurisprudence in procedural law can be considered an act of the exercise of International Public Authority.
