Flexible working time structures strengthen market positions in global competition and pro-mote a better work-life-balance. It is therefore not surprising that every second employee in Germany already has a working time account to make working time more flexible. The trend is rising.
While there are wide-ranging legal regulations for long-term-accounts, there are only a few special legal regulations in the area of short-term-accounts agreed under employment contracts (in German: „Flexikonten“). In practice, the high degree of contractual freedom of the parties is frequently exploited to the disadvantage of the employees. This dissertation examines in this context the legal requirements that the current law imposes on the agreement and management of flexible working time accounts under employment contracts.
At the beginning, mandatory minimum contents and the prerequisites for an effective com-pensation control regulation are presented. As a consequence of the control of the content of the general terms and conditions, there are absolute upper limits for the period of compensa-tion, which are oriented, among other things, to the agreed purposes. In addition, there is a legal requirement to limit the excessive build-up of time credits or debts during the compensa-tion period by means of bandwidth agreements.
In addition, the study also addresses the question of the form in which flexible account agreements must be agreed. The freedom of form under the employment contract must be restricted for reasons of transparency and a requirement of written form with a constitutive effect must be demanded.
Often flexible working time accounts are agreed between the parties to the employment contract that may prove to be ineffective under legal assessment. In consequence, the law in-tervenes, eliminating many of the advantages of flexible accounts to the disadvantage of employees. The study illustrates these disadvantages and describes possible legal consequenc-es that lead to a fair solution in the case of ineffective working time agreements.
The dissertation closes with a presentation of the legal requirements of an agreement of a working time account in the negative time area.
