Today, China faces a period of more than thirty years of successful economic reforms and opening-up policy. The system change from a planned to a market economy has been strengthened in this reform era. Meanwhile, the market orientation and the legal protection of intellectual property play an increasingly important role. In addition, an effective enforcement of intellectual property rights in terms of research and development costs is becoming increasingly important in the context of globalization of the world economy.
The legal copyright protection has been significantly expanded in China through two major reforms in terms of reaching out to an international standard level of protection. Despite very advanced laws, the Chinese are, however, faced with numerous difficulties, to increase the efficiency of law enforcement. In 2011, the International Trade Representation of the United States Government has published on its website a so-called "Notorious Market List", listing the companies that violate copyrights. One third of the companies listed are located in China. This shows that the fight against piracy and counterfeiting continues to be a very difficult task, even though in the recent years China has achieved progress in the implementation of China's copyright protection. The comparative law study deals with the current state of copyright in the Federal Republic of Germany and the People's Republic of China. The first part refers to the German copyright law. There are identified new developments and trends in copyright law. The second part deals with the Chinese copyright law. First, the Chinese legal system is briefly introduced and discussed the history and the current development of copyright in China.
