By means of the legislative instrument, the European legislature clearly extended the protection of vulnerable consumers. The study examines aspects of age-related advertising by critically considering commercial practices directly related to children and elderly consumers. The focus is on the question of the impact of the requirements of the Directive and of ist implementation on the interpretation of the relevant provisions of the German Unfair Competition Act. By analysing the relevant literature, case law and other rules of European and public international law, the study wishes to provide guidance for the interpretation of the amended statutory provisions of the German Unfair Competition Act which are of high importance for the protection of young and elderly consumers under unfair competition law.
