Effectively combating cross-border crime and ensuring cross-border security in the Federal Republic of Germany and the member states of the European Union requires cross-border cooperation between security authorities.
In a society characterised by information, this cooperation requires police forces and intelligence services in particular to exchange data with each other. However, the transfer of data is in tension with data protection, which has found legal form not only at national but also at European level.
This work deals with the cooperation between the police and intelligence services of the Federal Republic of Germany and the security authorities of neighbouring EU member states from the perspective of data protection law. It analyses the requirements and limits of data transfer from German to foreign authorities in detail.
This analysis closes a gap in the academic debate on cross-border data transfer in the field of security law. Finally, the results of the legal comparison are presented as a draft of an official form for data transfers. This serves as a guide for German police authorities and intelligence services when transferring data to other EU member states.
