About this book englishenglish

A better merger policy for the European Union is a never-ending old discussion that includes theoretical, political and practical debates.

This research focused on the issue from the merger control side and examined the accuracy of merger policy within the European Union. The competition understanding in the system is reviewed along with the merger rules. The demands from political and economic realities and crises of our era, reactions of similar markets to the same issue and the legal structure of the European Union guide the thesis to find an applicable and reasonable solution to improve merger control policies.

Merger Regimes of China, U.S.A. and Turkey are playing an essential role in this research on a comparative basis. Applications and approaches are reviewed in detail. The role of historical development in each of the reviewed jurisdictions has contributed to the findings of this research. The unique political and legal structure of the European Union will not be omitted; thus, the recommendations on a legal basis will comply with EU law.

Economy and political science theories that shape and explain the competition law are used to find answers. The role and feasibility of the political interests in merger policy are reviewed. The possible positive contribution of the European Court of Justice is included in this research. Adding more flexibility to the threshold system via the empowerment of the European Commission is also within the scope of this research. The question of European champions is addressed too.
