Collection service providers sometimes enjoy a rather dubious reputation in Germany. The costs they charge for their services are often regarded as excessive. A particular problem here is that the debtor is regularly required to pay the costs. This is based on the principles of tort law.
Within the framework of the so-called "Collection Law Reform", the legislator has made various amendments to the law which result in a reduction of fees under the German Lawyers' Fees Act (Rechtsanwaltsvergütungsgesetz) for certain circumstances. Particularly relevant are Sections 13 (2), 31b RVG together with the associated numbers in the VV RVG. This has an impact on the remuneration of collection services. Collection service providers regularly refer to the German Lawyers' Fees Act (Rechtsanwaltsvergütungsgesetz) when calculating their remuneration, as the creditor can demand compensation for the RVG fees from the debtor on the basis of Section 13e (1) RDG.
In the main part of his scientific investigation, the author pursues the question of whether the collection service providers' fundamental rights are violated by the aforementioned standards. In particular, a possible violation of Article 12 (1) of the German Basic Law is examined comprehensively.
Furthermore, the principles of tort law with regard to the reimbursement of collection costs are explained and alternative solutions to the aforementioned standards are proposed. The proposed solutions pursue the goal of protecting debtors in a comparable manner while at the same time placing less of a burden on collection service providers.
