The Wirecard AG case has been an integral part of the business press for some time. The case is about an unprecedented scandal of a DAX-company. The longer one deals with this topic, the more unbelievable the omissions seem. The book clearly shows a possible state liability claim against the Federal Republic of Germany and the Federal Financial Supervisory Authority. The basis for possible liability is the Transparency Directive, which has not received any special attention to date, but is the cornerstone for all actions and obligations in the enforcement of financial information. As an introduction, enforcement of financial information in Germany until December 31, 2021 is described and the legal basis is explained. Official duties are worked out on a legally sound basis and a potential violation of these with regard to a claim is checked. It is shown how potential damage has to be calculated and how this could be procedurally enforced. The issues and official duties dealt with have not been the focus of the court proceedings so far and a submission to the European Court of Justice or the Federal Constitutional Court can be eagerly awaited. In addition, the book offers a comprehensive and up-to-date claim check with all the necessary sources for a comparable claim. Due to the fact that in many areas German law is either shaped by guidelines or regulations are directly applicable, a constant critical scrutiny of official actions and duties of officials is required.
