Housing is an important prerequisite for every human being in order to participate in the social community. This requires legal institutions for housing assistance, namely to build social housing in the broader sense, as part of social law. Not only in Germany, but also in China there is a legal institution for overcoming or preventing housing shortage. It provides housing assistance for those vulnerable groups that can only with difficulty acquire living room on the real estate market. Due to the historical reception of German law in China, this legal institution is treated by the author from the standpoint of comparative law, both in macro comparison and in micro comparison, between Germany and China. However, social housing in Germany and China has different purposes. This means that, on the one hand, the comparison of law may contribute to a better understanding of the social housing laws of one’s own country. On the other hand, it may also be fruitful for supporting trade between Germany and China. The main difference in social housing between the two countries obviously lies in the fact that, in contrast to German social housing, the Chinese institution is based on planned economy. The reasons for this difference can be found not only in history, but also in current political backgrounds. At the same time, the comparative analysis shows that the reform of social housing is dependent on the rationalization of the overall real estate system. In summary, it can be concluded that social housing in Germany may represent a model for the future reform of social housing in China, especially for the unification of the Chinese legal institutions regarding object assistance and the transformation of the Housing Provident Fund.Keywords
