The present work focuses on the Bulgarian transport law in comparison with the international transport conventions CMR, CIM and SMGS and the German transport law. The handling of the Bulgarian law is confined to the shipment of goods by road and by rail. The air transport and the merchant shipping have been treated, if necessary. Studying Bulgarian transport law (shipment of goods by rail and by road) it becomes apparent that it is strongly fragmented in contrast to the German transport law present-day. In fact there are general transport rules in the Bulgarian Commercial Code. But in addition, special rules apply for the respective modes of transport, which are geared to the international conventions: So the Bulgarian shipment of goods by road complies with the international convention CMR, the Bulgarian shipment of goods by rail manoeuvres between the CIM and SMGS. This said fragmentation causes particularly double, particularly dissent and particularly opposed contradictory rules. The modes of transport which is concerned become unattractive for their customers, so that the legal prerequisites for a competitive transport system have not been fulfilled. These said weaknesses can be remedied by general transport rules for the main means of transport of Bulgaria.Keywords
