In recent years, innovative online platforms such as Amazon, Uber and Airbnb have revamped the way people traditionally interact with one another financially. In the legal community, it has sparked a controversy as to whether the current legal system is prepared outright to encounter the legal issues arising from the platform economy or it needs to be adjusted accordingly. A serious step towards an implementation of this economic concept in law was comprehensively approved by the French parliament in 2016. The amended new French legal framework provides platform-specific provisions in several national codes like the Code de la consommation, Code des transports and Code du tourisme attempting to address the legal problems associated with online platforms.

The work at hand sheds light on those legal adjustments dealing with the somewhat non-transparent legal relationships between the involved parties. In addition, the complex legal structure of the liability of an intermediary as well as the rules regarding transparency and fairness, so-called loyauté, will be illustrated in detail.

A point that merits specific attention is the compatibility of the liability of online platforms with several European directives. It can be assumed that the consumer is not sufficiently protected by law when interacting online.

Lastly, the book will go into depth on some particular acts regarding the transport and short-term accommodation sector with a special focus on platform liability and its compatibility with the French constitution.

Overall, the present work provides an in-depth insight into legal developments in France with respect to an issue that has not been addressed by any other legal framework to this extent before.
