The liability of the actual carrier was standardized in § 509 HGB through the German merchant shipping law reform of 2013. Its reason was the fact that, with increasing frequency, contractual carriers assign the actual performance of the carriage of goods by sea to other subcarriers. The consequence for the shipper and the consignee is that involving more persons in the carriage makes the situation more complicated. The imprecise wording of § 509 HGB results in discussions and problems that arise in legal practice. This study discusses all questions that arise regarding the liability of the actual carrier and takes the latest literature and court rulings into consideration. Furthermore, proposals for the interpretation and possible modification of § 509 HGB are worded. In addition, this study refers to International Conventions for the unification of law such as the Hamburg Rules or the Rotterdam Rules.
