The electronical commerce of music works has established several new ways of their use. Such an example can be found in the so-called audio samples. The latter are excerpts of music works which are freely available on websites where music recordings are being sold. These samples allow the consumer to take a “look” into the recording and therefore simplify the decision on purchasing the recording or not.

The purpose of this book lies in examining the permissibility of this practice according to German copyright law, when the author or the performer has not authorized such a use. A copyright examination of the significance of a music work excerpt in relation to the work in its entirety takes place in the first part. Afterwards the permissibility of audio samples is examined from the scope of moral and economic rights. This is followed by an examination on whether an audio sample can be a substitute for acquiring the recording of the music work. The permissibility of audio samples is also proved in relation to the first sale doctrine and the interpretation of agreements with German collecting societies GEMA and GVL. Finally an examination takes place on whether the unauthorized use of audio samples can justify potential claims for the author or performer.
