About this book deutsch english

Ferdinand Regelsberger was an important pandectist of the 19th century. In 1893, the first and only volume of his textbook was published, dealing with the general doctrines of pandect law. A continuation on property law, the law of obligations, family law and the law of succession was never published. His work remained unfinished. Regelsberger had ordered that all drafts of his literary works be destroyed after his death. All the more significant is a transcript that a student made during one of Regelsberger’s lectures in Gießen. Regelsberger taught at the University of Gießen from 1868 to 1872. With the help of this transcript, the present work provides an insight into Ferdinand Regelsberger’s doctrine.

In the first part, the author introduces Ferdinand Regelsberger as a person and then places the lecture notes in the context of Regelsberger’s academic work. An overview of the structure and content of the lecture is followed by an analysis. Topics such as the concept and sources of law, the doctrine of possession and the assumption of debt are covered as well as the doctrine of assignment, the fiduciary transaction and the contract in favour of a third party. The second part comprises the edition of the lecture notes. In addition to the general doctrines, the transcript also contains a presentation of the law of obligations and property law as well as family law, thus creating the opportunity to comprehend Regelsberger’s views on these subject areas. It offers a valuable supplement to his works.
