The bias of the public prosecutor is still an ongoing topic in Germany, especially as for prosecutors - in contrast to judges – legal provisions with regard to bias do not exist. This is incomprehensible, especially since the public prosecutor in most proceedings takes judiciary positions (§ 153 f StPO, penalty orders) and is also committed to neutrality.
In contrast, before and after the 2008 and 2011 reforms, the Austrian and Swiss legislators enacted special provisions in order to encounter a biased prosecutor.
In addition, the United States has decades of jurisdiction and codification with regard to the bias of prosecutors.
For the first time, this book deals with a detailed comparative law study of the different countries and the respective theoretical and practical approaches to the prosecutor's bias.
First of all, the bias of the public prosecutor in Germany is presented on the basis of practice-relevant case constellations. Thereafter, the solution approaches developed in case law and teaching are shown.
Then, identical and similar case constellations of Austrian, Swiss and American law are compared. By this comparison, similarities and differences can be excellently mapped.
Notably the comparison within the D-A-CH countries makes it clear that the creation of a German regulation on the bias of public prosecutors is urgently required! However, the comparison also reveals the weak points of the bias laws in Austria, Switzerland and the US.
The author developed successively a model rule, which is the basis of a national bias law for prosecutors in Germany and can be the basis of a Europe-wide unitary rule. Finally, the extensive annotations of this model provide valuable clues for litigants.
