The book discusses a topic that is highly relevant in practice but that has not been part of an in-depth legal discussion yet. It is about the specific obligations of public procurement law that the recipients of public donations have to meet. Thus, the topic “Zuwendungsvergaberecht” is in between the fields of procurement law, donation law and general administrative law.
An allocation decision usually contains standardized ancillary conditions (so called “ANBest”). Part of the ANBest are, inter alia, obligations to meet the requirements of public procurement law. If those obligations are violated the competent authority is allowed to partly reclaim the provided subsidies. This even applies if the recipient is not a public contracting authority and, therefore, does not inherently fall within the scope of public procurement law.
The dissertation answers the question whether this way of extending the scope of the procurement law provisions is lawful. Further, various proposals for modifications of the “Zuwendungsvergaberecht” are made.
