A verification of an employment relationship, for an employer as well for an employee, proves to be an indispensable part in order to successfully conclude a permanent employment contract. However, due to legal requirements of a dismissal there are obstacles to end an employment fast and easy in a case the trial period proves to be unsuccessful.
The book deals with the “Erprobungsverhältnis”, the legal possibilities to try out an employment relationship in concrete terms, before concluding a permanent employment contract. The “Erprobungsverhältnis” is examined in a legal comparison of the German and the Dutch legal system, containing a critical analysis of the regulations from historical background, legal mindset and aspired goals.
The work ends with a summarized proposal, primarily combining means of legal concepts of both, Dutch and German legal systems. The suggested solutions offer a basis for possible legislative reforms applicable for both countries.
