Applicable data protection law in Germany dates back to a time when the Internet did not play a notable role in every day’s communication. Its basic principles are laid down in the 1995 EU-data protection directive. Its constitutional basis was laid by the Constitutional Court´s famous census decision, even before, in 1983. As enormous technical and social developments have taken place since then, German data protection law is often considered to be outdated. The European Union has presented the draft of a European data protection Regulation to adopt data protection and privacy law to the “Age of Internet”. Against this background the present thesis analyses whether the applicable data protection law leads to appropriate legal results with regard to social media. The thesis identifies several problem areas concerning inter alia the notion of consent, the distribution of responsibility or the applicable law on international data processing. Based on this analysis proposals to develop data protection law are presented. Finally the thesis examines to what extent the planned EU data protection regulation might help to overcome the recent shortcomings of data protection law.
