The Maidan revolution in Ukraine indicated popular protest to dysfunctional and corrupt state system as well as an attempt to replace old authoritarian tradition with West-European legal and political traditions. The new elected government promised a broad package of constitutional and judicial reforms that were and still have to be introduced for legislative procedures and public discourse.
This anthology comprises of the results of a legal-comparative seminar held by the Netzwerk Ost-West (East-West Exchange Network) in 2014 on the protection of state and rule of law in democratic criminal law. In joint essays students of the Humboldt University Berlin and the Taras-Shevchenko-University in Kyiv analyse theoretical foundations of modern constitutional state and its protective tools within constitutional and criminal law. Through the combination of public and criminal law topics the anthology provides profound insight into such topics as the protection of free speech, freedom of assembly, penalisation of state employees and journalists.
