Online archives store old newspaper articles permanently and make this information available for the public. This makes them a valuable source for research. At the same time, people who appear in these articles by name might feel hurt in their personal rights and could try to enforce a so-called “right to be forgotten”.

The study examines, if claims for erasure or correction of old newspaper articles are justifiable and explains their premises. This is studied from three different legal perspectives: personal rights, data privacy laws and copyright law. An important aspect in this analysis is the comparison between traditional and digital archives.

In the past years, German jurisdiction has developed several general criteria to judge the lawfulness of old newspaper articles in online archives that identify delinquents. These criteria are analyzed and advanced for other forms of news coverage in digital archives. The author especially examines if an old article that is archived in the internet can be put on a par with a new reporting and how this might affect its lawfulness.

The book also examines whether data privacy laws are applicable to digital media archives.

Certain material stored in online archives can also violate copyright law. However, German law provides several restrictions for the holder of copyright which privilege media activities. The work therefore analyses if those restrictions can be applied to online archives.
