The international criminal justice system has encountered a substantive renaissance since the 1990ies. For the first time since the end of the World War II, (prison-) sentences handed down by an international tribunal have to be executed. The sentences of the international criminal tribunals – among them the ICTY, ICTR and the ICC – are executed in and by third party states and not by the tribunals themselves. This results in a complex conglomerate of legal regulations governing the execution of those sentences. Those sentenced by the international criminal tribunals find themselves in a legal context where little is certain. Not even the most basic and elemental human rights such as those enumerated in the European Convention on Human Rights (ECHR) are guaranteed. Germany has also undertaken the task of enforcing the sentences of the international criminal tribunals. Does that mean that there actually are prisoners in German prisons whose legal status is far from clear? The author analyses the underlying legal network governing the execution and gives answers to the pending questions. He relies not only on a German perspective while doing so, but incorporates the problems in other executing states. A special focus is laid on the binding force of elemental human rights both for the executing states and for the international tribunals themselves. Cases involving Germany are of particular relevance for the author: He gives detailed instructions on how to deal with the small prison population of those convicted by the international criminal tribunals. For the first time, the author’s work offers a concise look into the problems of enforcing the sentences of the international criminal tribunals.
