Within the recent years both, in social and medical regard, there have been developments aroused that provide the legislature with great challenges. In the present case there is a constellation in which the partners of a non-martial partnership realize their wish by heterologous insemination.

Hereby, the legislature expressly permitted (though), that non-marital couples may participate in the advances of reproductive medicine. At the same time the legislature ignores that all involved parties for such a special constellation, yield special problems that cannot be solved with the existing legal regulations.

For a child conceived by means of heterologous insemination in results of ist legal status of paternal lineage - as opposed to a child born in wedlock – there is a major drawback, since neither the "pater est" rule comes into effect yet, another assumption fact exists. This does have at least negative impact on the children’s maintenance salary and inheritance rights.

For the sperm donor is given by the constitutionally protected right to know one's origin and the consequent exclusion of anonymization of his personal data a significant risk to be taken claim by a child conceived by his sperm with regard to maintenance and inheritance claim. Since the realistic risk that the donations will continue to go down for this reason, this constellation has over the individual's fate beyond considerable socio-political impact and thus a very far-reaching significance.

The author intended their work to find a solution that ensures a fair balance of interests of all parties. In this case the focus is directed to the interests of the children, their status, particularly in maintenance salary and terms of inheritance from the beginning to know secured and to avoid a corresponding call to the interest of a sperm donor.

At first, the author examines the regulations, which subject to the corresponding laws and regulations in Germany, Austria, the United States of America and Switzerland. Outgoing the author weighs in a comparative law the different regulations against each other and examines to what extent in foreign jurisdictions solutions can be found that could be transferable to German law. After all, the author submitted a proposal for reform, through which an equitable balance of interests is possible for all involved parties.
