After decades of controversy this book attempts a doctrinal (legal dogmatic) classification of § 1371 I-III BGB drawing on legal historical and comparative law methods.

First, the book outlines the legal historical framework of matrimonial property law (Güterrecht) and of the matrimonial property regime (Güterstand) of the community of accrued gain (Zugewinngemeinschaft) as well as the equalisation of accrued gains (Zugewinnausgleich). Only by identifying the origin and giving an account of the historical development process is it possible to come to an informed view of the present regulatory approach.

The book then deals with the questions of the legitimation and the shortcomings of § 1371 I-III BGB as well as the legal basis of the choice between the equalisation of accrued gains (Zugewinnausgleich) according to § 1371 I BGB and § 1371 II-III BGB.

Finally, after considering both the weaknesses and the strengths of the current approach to regulation a proposal for reform of the equalisation of accrued gains (Zugewinnausgleich) according to § 1371 I-III BGB is developed.
