Creating prognosis assessments for the evaluation of the recidivism risk of delinquents is one of the classic fields of activity of psychiatrists and psychologists. They are consulted if required by law or when the court lacks the necessary expertise. In order to make a prediction about the future criminal behavior of a delinquent, it has ever since been the attempt to determine the key factors linked to recidivism. Lawyers and criminologists had already published lists of characteristics at the beginning of the 20th century. But especially over the last two decades, different research groups concentrated on the creation of the so called actuarial prediction instruments.

Therefore standardized prognosis instruments have been developed, primarily in the Anglo-American world. But they are also an integral part of expert’s opinions in Germany since the 1990s, being regarded as important techniques in risk assessment.

But do they really work? And to what extend are they “compatible” with the rules and principles of the German criminal procedure? These are the questions the author is pursuing in her thesis.

As a matter of fact, lawyers involved in criminal proceedings are little informed about the principles and the validity of standardized instruments. Hence, the author considers the imparting of knowledge about the functionality of standardized prognosis instruments as a crucial task, since there is no end of the development of new instruments and the use of already approved ones in sight. Only by this, an adequate legal assessment of expert`s opinions can be ensured.

Her work demonstrates advantages, limitations and perils of the usage of standardized prognosis instruments on the basis of three instruments established in German criminal procedure (PCL-R, HCR-20 and Static-99). In so doing, their compatibility with significant criminal legal principles is being examined.

The author offers valuable information for the criminal procedural practice, to realistically assess the relevance of expert opinion’s based on standardized prognosis instruments.
