Taking a comparative perspective, the author elaborates on the constitutional values of (personal) freedom and (national) security, which lie at the very heart of German and American constitutional law alike, and often clash when new antiterrorism laws are implemented. More than ten years after the attacks on the World Trade Center and after the death of their chief plotter, Osama bin Laden, the Boston Marathon bombings of 2013 remind Western societies that, despite all their security efforts, they remain vulnerable to terrorists. The war on terror continues. But how much security can and must a democratic state – a Rechtsstaat in the German sense – provide to ist citizens without unduly sacrificing their liberties and ist core constitutional principles?

Knowing as much as possible as early as possible about potential terrorists and their plots was and is essential in order to successfully prevent future devastating attacks. Consequentially, the new antiterrorism laws, often adopted after only short deliberations in the immediate aftermath of 9/11, such as the USA PATRIOT ACT, provide for extensive government surveillance powers. Citing the example of the FBI’s power to secretly issue so called National Security Letters (NSL) and the comparable clandestine powers of the German intelligence services, the author analyzes the constitutional safeguards of the German and the American citizens’ right to privacy, such as the American subpoena regime, against a sweeping gathering of (allegedly) necessary information by the government.
