Background to the Creation of the Book
The book “The Right of Assembly in the Age of Protest, Flash Mobs, and Angry Citizens” emerged from the author's intensive academic and practical engagement with German assembly law during a period of profound societal change. The starting point of the work was the realization that classical forms of public assembly are increasingly being supplemented or replaced by new, more spontaneous forms of protest—such as flash mobs or online-supported demonstrations.
As part of his doctoral studies in law at the FernUniversität in Hagen, Jens Usebach systematically examined, under the supervision of Prof. Dr. Haratsch, the extent to which the current law on assembly—as enshrined in Article 8 of the German Basic Law—remains adequate for contemporary needs. In light of new social movements, including the rise of so-called "angry citizens" (“Wutbürger”) and the growing digitalization of protest, the need for a legal reassessment became increasingly evident.
His many years of practical experience as a specialist lawyer for labor and social law, as well as his commitment to fundamental and civil liberties, significantly shaped the book’s perspective. The work is not only a legal analysis of historical and current legislation but also explores the social and political developments that define modern forms of assembly.
With this book, Jens Usebach aims to contribute to the further development of assembly law by demonstrating how jurisprudence and lawmakers can—and must—respond to the challenges of an evolving culture of protest.

Diese Dissertation sollte in keiner Bibliothek der juristischen Fakultäten, Verwaltungsgerichte, Versammlungsbehörden, Polizeidienststellen sowie Anwaltskanzleien für Verwaltungsrecht fehlen. Den Studierenden an den Fachhochschulen der Polizeien des Bundes und der Länder wird der durchaus angemessene Preis zumeist für einen Kauf zu hoch sein; es lohnt sich aber sehr in den entsprechenden Bibliotheken dieser Einrichtungen mehr als nur einen Blick in das Werk zu werfen; dies gilt auch für Studenten der juristischen Fakultäten und Referendare. Professoren und Dozenten für Polizei- und/oder Versammlungsrecht ist diese Lektüre uneingeschränkt zu empfehlen; für den mit dem Versammlungsrecht befassten Juristen ist die Lektüre ein uneingeschränktes Muss.

About Jens Usebach
Jens Usebach, born on January 19, 1980, in Göttingen, is a highly qualified lawyer with an economic background and extensive professional experience across various sectors. After completing his secondary education with a focus on economics, he first trained as an industrial clerk. He then went on to study law at the University of Cologne. This was followed by the First State Examination and a legal traineeship (Referendariat) that included placements at the public prosecutor’s office and the labor court, culminating in the successful completion of the Second State Examination.
Alongside his law degree, he completed a postgraduate Master of Laws (LL.M.) in legal practice at the FernUniversität in Hagen. From 2017 to 2025, he pursued a doctoral degree focusing on the right of assembly.
Jens Usebach is a certified specialist in both social law and labor law. Since 2017, he has been working as an independent attorney at his Cologne-based law firm JURA.CC, which specializes in protection against dismissal. His professional experience includes positions in media companies, the real estate sector, and legal publishing, where he has also served as a legal expert.
