The word ‘mediation’ is on everyone's lips these days. At first glance, mediation appears to be a panacea for conflict resolution. In keeping with the spirit of the times, both the German and Russian legislatures passed mediation laws almost simultaneously.
More than ten years have passed since then, so it is time to take stock of whether mediation has arrived as a new method of dispute resolution in the centre of German and Russian society and thus offers an alternative to the state courts. The study answers this question in the negative. It also crystallises the similarities and differences between the respective regulatory approaches and highlights their advantages and disadvantages.
The study provides an answer to the question of what challenges the respective legal systems are currently facing. Furthermore, with a view to the future, concrete measures are proposed to anchor and sustainably strengthen mediation as an alternative dispute resolution method in the minds of people in both Germany and Russia.
