Solitary confinement is and remains one of the most controversial forms of deprivation of liberty. With reference to the negative physical and psychological consequences, there are voices arguing for the abolition or legal restriction of solitary confinement. However, there are also voices in favor of maintaining solitary confinement. However, a look at the practice shows that solitary confinement is an indispensable part of the national penal system. From a state perspective, an effective penal system in any case require the ability to respond to very specific situations by imposing solitary confinement. Based on this fact and the negative consequences associated with this form of detention, several international organizations have formulated recommendations to their member states. These recommendations aim to establish or maintain a minimum level of protection for prisoners in solitary confinement at the national level. However, this recommendations are not binding. Therefore, they merely provide states with a kind of “model solution” for dealing with this form of detention. It is generally left to the discretion of the states whether and how these provisions are actually implemented in national law. This article examines the extent to which Austrian provisions on solitary confinement are consistent with the non-binding recommendations of certain international organizations and institutions, based on a number of key recommendations.
