About this book deutschenglish

Looking at the German national newspapers of the last few years, you get the impression that the farewell to the legal profession is imminent. There are reports about technical applications, so-called Legal Tech, which are supposed to replace lawyers in the future. But what is Legal Tech all about and will we really be entrusting our legal questions to robot lawyers in the future? An imminent end of the legal profession is doubtful - but in fact, as Legal Tech continues to develop, the question arises as to what extent the legal advisory profession will change.

With the ruling in the wenigermiete.de case (BGH Urt. v. 27.11.2019 - VIII ZR 285/18), the Federal Supreme Court ruled for the first time on the admissibility of the business models of online services that advertise to replace a visit to a lawyer. For the legal services market, the landmark ruling brought some challenges, but also opportunities. Legal Tech is no longer a newfangled fringe phenomenon for the tech-savvy, but is firmly part of the legal services market. However, it is becoming clear that there is a tension between the law governing the legal profession and the current and advancing developments in the digital legal services market. The legal framework for debt collection service providers and the legal profession is in need of adaptation in view of the new challenges posed by the digital age. The legislator (partially) met this concern by reforming the law on legal services in October 2021.

What is clear is that not everything has been clarified and time will bring further changes. Questions arise such as: Where could the legal framework be further adapted? What are the consequences of advancing digitalisation for legal education? Will people seeking justice actually be able to have their rights enforced by a robot lawyer in the future? And what needs to happen for the legal profession to reach a modus vivendi with Legal Tech? One thing is certain, however: Legal Tech is here to stay.
