Cannabis has always been a topic that polarizes – in legal, medical, social or political terms.
The study analyzes the extent to which medical cannabis has established itself in Germany over the years. The research questions were provoked by the recent history of medical cannabis in jurisprudence and legislation: The decision of the Federal Administrative Court of April 6th, 2016, was groundbreaking. In this judgement, the court granted a seriously ill patient the right to grow medical cannabis for personal use in his home. With the Act Amending Narcotics Law and Other Regulations, which came into force on March 10th, 2017, the legal situation finally changed fundamentally: For the first time, the legisator made medical cannabis largely prescribable. At the same time, it introduced a reimbursement status in statutory health insurance with Section 31 (6) of the German Social Security Code (SGB V).
In her paper, the author presents the legal situation regarding prescribing and reimbursement before and after the introduction of the new law. The focus is on Section 31 (6) SGB V. Prerequisites as well as legal consequences are considered in detail. In addition, numerous court decisions are used to explain which legal problem areas exist. In this way, the new regulation is viewed critically and any need for improvement is identified.
