The legal position of interns is problematic in many respects under labour and social security law. In addition to the classic question of status (which is extremely difficult in relation to internships), there are numerous norms, especially in social security law, which have differentiated social security consequences for internships in the various branches of social security. Difficult questions also arise in the context of labour law - for example, when it comes to the remuneration of interns. Through the introduction of the MiLoG and the equalisation of interns with employees within the meaning of the MiLoG, the legislator has standardised additional criteria for remuneration in addition to the already existing regulations of the BBiG. The complexity of the issue is further increased by the fact that the term "internship" is already ambiguous and covers very different constellations. The spectrum ranges from the classic company internship of a pupil to an internship of a university graduate looking for work. Between these types of internships lie the internships of students before or during their studies. In a landmark decision in 1974, the Federal Labour Court developed criteria for the legal treatment and applicability of the BBiG, which the author discusses in more detail. Dealing with such internships in terms of labour and social security law is extremely difficult for companies. The author has made it his task to systematise trainee relationships and to precisely analyse the legal questions that arise in each case. Another concern of the work was to uncover systemic distortions and to develop (not least legislative) measures for a systemically coherent regulatory concept.
