This book deals with the tension between family and transaction protection in Chinese marital property law under the circumstance that one spouse disposes of the community property of the couple without authorization. The purpose of this book is to compare with the European sample regulations to get the enlightenment for the revision of Chinese law and put forward corresponding suggestions. The “Principles of European Family Law Regarding Property Relations Between Spouses” of the Commission on European Family Law (CEFL) offers itself as a reference framework of the study, as it must be involved as a family law standardization project in European legal systems with different matrimonial property regimes.

One of the greatest strengths of this book is the empirical research and data analysis of cases of the Chinese courts. The author makes a comparative study based on individual case groups. The mentioned “statistical overview” and the statistical data attached to the individual sections in the third part of this book impressively demonstrate that the author with great care has won with great detailed findings on the practical relevance of the topic. The field of tension of this book is characterized by the conflicts between the marriage law, contract law, tort law and company law. The author of this book focuses on a series of issues under the system of separate laws enacted during different periods before the Civil Code came into force in 2021, such as the authorization and commitment of the spouse, the rights of disposition, and the acquisition in good faith.

One thing special about this book is that in the process of its formation, the Chinese legislator successfully compiled the legislative blueprint into a comprehensive Chinese Civil Code.
