The longest period provided for in German statute of limitations law is 30 years. It applies in particular to judicially determined claims. The paper shows that under certain conditions the 30-year limitation period can be interrupted by a renewed declaratory action. The ne-bis-in-idem-principle is broken in this respect. In extreme cases, this creates an „infinite“ limitation period.
The paper shows that this „infinite“ limitation period fits into the system of limitation law under the German Civil Code. It discusses alternative approaches to a solution, and examines in particular, whether more appropriate solutions can be achieved by modifying the principle of unity of damage. The study confirms the approach of the Federal Court of Justice (BGH) in its judgement of 22. February 2018 – VII ZR 253/16.
