The book provides a glimpse into the Hungarian legal system in relation to the practical significance of the new Fundamental Law and the new Organic Law on the Constitutional Court of Hungary, which came into force in 2010, after Fidesz - the Hungarian Civil Alliance, a right-wing populist and national conservative political party - and the Christian Democratic People’s Party (KDNP) have prevailed in the parliamentary elections in Hungary with a two-thirds majority.
Due to a long public debate between the European Commission for Democracy through Law (an institution of the Council of Europe and better known as the „Venice Commission“) and the Hungarian Parliament, the author makes an analysis of the Hungarian constitutional jurisdiction, which was changed after 2010, taking into account the European models.
Accordingly, based on the various European legal systems, the author tries to make a contribution to clarifying the composition of the Hungarian Constitutional Court, the election of the constitutional judges and the various legal remedies.
Objective control remedies, constitutional complaints, presidential charges, control of referendums, disputes between organs, types of procedures related to local self-governing bodies and the unique competences of the Hungarian Constitutional Court are discussed. Even with a detailed explanation of the individual constitutional court proceedings, this study remains structured and clear and examines in detail the diversity of the particular features of the various Hungarian types of proceedings.
The author attaches great importance to addressing the problems that arise in practice.
