The author analyses the forms of consensual dispute resolution in German civil proceedings. Experience reports from practice indicate that the possibilities created by the legislator with the Act to Promote Mediation and Other Methods of Out-of-Court Dispute resolution in 2012, have since not been sufficiently exploited.
The study elaborates the similarities and differences of the forms of consensual dispute resolution, considering the available design options. The aim is to develop guidelines that can be taken into account in the exercise of judicial discretion on the basis of a comparative approach.
