In the 19th century, the territories of today’s African states were the target of colonialism driven by the European powers. It was not until 1960 that most African states gained independence. Even after decolonization, the consequences of colonialism are still present. With decolonization, the African states adopted the European state model and today’s international legal order, which is also European in its origin. It was impossible to transfer pre-colonial power structures or legal systems of the indigenous communities into the post-colonial independence of the African states. One of the consequences of this are deficits in legitimacy. These legitimacy deficits are one reason for internal tensions, political unrest and conflict-ridden fragmentation efforts that many African states are facing.

This study examines whether elements of a pre-colonial legal subjectivity of indigenous communities beyond international law can contribute to overcome these legitimacy deficits. The first part of the study demonstrates the existence of a pre-colonial legal subjectivity beyond international law and the associated inter-community legal systems of indigenous communities in Africa.

The main part of the work discusses the effects of early and high colonialism on the precolonial legal subjectivity of indigenous communities beyond international law. At the core of the study are the legal relationships between the legal systems of indigenous communities and the legal systems of the colonial powers during colonialism. In addition to the state practice of the European powers, the study also examines the effects of the numerous agreements between the colonial powers and the indigenous communities and the consequences of the administration of the colonial territories. In the concluding section, the work returns to the initial question, considering the insights gained previously, using two examples to illustrate possibilities at state level for dealing with post-colonial legitimacy deficits.
