Considering the tension between the privacy rights of a person on the one hand and the freedom of expression and media on the other hand, the book examines, how effective the existing legal instruments are in cases of outdated, legitimate suspicion-reporting, paying special attention to the development of the information society. The author discusses whether and, if so, under what circumstances, those affected by an outdated report are entitled to follow-up claims under the current legal situation and to what extent the existing protection meets the needs of legal reality or, if need be, needs to be strengthened.

To begin with, the author devotes herself to the suspicion-reporting. Since a previous lawful suspicion-reporting is the starting point for the investigation, the requirements for said reporting developed by the jurisprudence are convincingly examined.

The author continues with a precise presentation of the existing press law instruments for eliminating consequences in case of suspicion-reporting. Subsequently, following the critical result of a comprehensive evaluation of case law and literature in the event of outdated legitimate suspicion-reporting, a concrete proposal for the recognition of a claim to „follow-up-reporting“ is made. The author extensively discusses how such a claim serves as a further development of the existing press law instruments and more effective protection of the victims without putting too much strain on the media. The prerequisites, design and practical implementation of the proposed claim for “follow-up-reporting” are examined in detail.
