In its landmark decisions of 1955 and 1985, the Federal Labor Court established a general employment claim. This claim allows employees to demand actual employment from their employer in addition to contractual remuneration. There is no entitlement to employment if the employer’s overriding protective interests conflict with actual employment.

The author first looks into the development of the general claim to employment in the case law of the Federal Labour Court and assesses the criticism thereto in case law and literature. The author then applies the findings on the general claim to employment to the situation in sports. The study focuses on the employment of athletes and coaches in team sports. In addition, particular differences in individual sports are also highlighted.

The general employment claim of athletes and coaches is examined from various angles in the study. The author also takes up some cases from sports practice. In addition to the question under which conditions the general employment entitlement of athletes and coaches can be suspended („whether“ of employment), the author examines questions related to the fulfilment of the general employment entitlement by the clubs as employers („how“ of employment). The starting point for the suspension of the general employment entitlement is the predominant protective interests of the employer. On the other hand, the fulfilment of the general employment claim is based on the employer’s right of direction according to § 106 p. 1 GewO. This can also be contractually extended („transfer clause“).

The investigation concludes with considerations regarding the legal consequences of a violation of the general employment claim of athletes and trainers (judicial enforcement and claims for damages).
