About this book deutschenglish

Especially in times of globalisation on the one hand and territorial separation on the other, keyword Brexit, and the resulting increasingly complex international markets in the area of the sale of goods, it is extremely important to create uniform legal regulations in order to enable smooth international trade in goods.

The present scientific work "The perfect tender rule of the UCC and the contract cancellation in the CSIG" therefore deals with the international law of sale of goods. The author compares certain regulations of the United States of America (UCC) with the United Nations Convention on the International Sale of Goods (CISG), also known as the Vienna Sales Convention.

The core of the work is the "perfect tender rule", a regulation of the US law of sale of goods, which enables the buyer to reject the acceptances of goods that are not perfect. This is compared to the contract cancellation regulations of the CISG, as the CISG requires a substantial defect of the delivered goods as a threshold for cancellation of the contract and thus follows a completely opposite approach as the "perfect tender rule".

After an intensive comparison of the "perfect tender rule" of the UCC and the contract cancellation provisions of the CISG, the author not only describes his findings but also presents helpful approaches for future solutions.

With his work, the author takes up one of the points that critics of the CISG have repeatedly criticised and thus takes part in the current academic debate on the CISG.

In doing so, the author illustrates the theoretical part of the work with a constantly changing practical case, so that the work is of great interest to both scientists and practitioners.
