The coalition agreement of the 19th legislative period declares that expanding broadband with fibre-optic infrastructures by the end of 2025 shall be a top priority for the state. Since the market is unable to supply the population with high bit-rate services on its own, state actors provide billions of Euros in subsidies. The aim now is to distribute these subsidies from underserved regions to developing telecommunications companies in accordance with the law. The subject of this work is the specific structure of the competitive tender procedure for the provision of subsidies, which implements both the requirements of state aid law and public procurement law.

The work begins by identifying the network architecture of next-generation telecommunications networks and the individual stages of the value chain in the telecommunications sector. It then examines the requirements of state aid law for the design of an open, transparent and non-discriminatory tender procedure. Taking these results into account, the work then uses empirical data collection to demonstrate how local authorities have so far interpreted and put into practice under state aid law the maxim of conducting an open, transparent and non-discriminatory tender procedure. The work then investigates whether the provision of subsidies to telecommunications companies for purposes of eliminating broadband undersupply constitutes a relevant public procurement law procedure. It also answers the legally crucial question as to whether the provision of state aid to eliminate broadband undersupply constitutes an award of a (service) concession without exception. The work concludes by showing which paths of legal protection an unsuccessful bidder can take in order to avoid – from the bidder’s perspective – the illicit selection of a competitor.
