The basics of the German legal institution of indebtedness as a reason to initiate an insolvency proceeding are still not adequately examined. This book is a detailed and thorough piece covering all aspects of this important subject. In case of indebtedness the priority principle is replaced by the principle of equal distribution. Consequently, the institution has drastic consequences for debtors and creditors.
The “Insolvenzordnung”, the German insolvency act, lays down three reasons to initiate an insolvency proceeding. The author analyses the dogmatic position of indebtedness in this system (§§ 1–4) as well as the functions and requirements (§§ 5–8). Afterwards, the author shows the historical development of the legal institution, from its beginning in Roman law to modern legislation during the financial crisis (§§ 9–12).
This work answers the question, which reasons justify dismissing the priority principle in favour of the principle of equal distribution during insolvency proceedings. The author also takes a critical look at the compatibility of indebtedness as a legal institution with the “Grundgesetz”, the German constitution (§§ 13 - 15). Subsequently, he examines and analyses the characteristics of the legal institution one by one (§§ 16–20).
