Employees protected under special termination protection do not take part in the choice that is to be made under general termination protection in case of termination.
Based on this, the paper first focuses on manipulative use of special dismissal protection regarding the general dismissal protection regulations (KSchG). Especially the TzBfG appears to be suitable to do so. § 15 Sec. 3 TzBfG allows to systematically exchange employees protected by the KSchG.
On purpose a surplus of employees could be created which the employer could eliminate by terminating employment contracts. But the previous contracts would be terminated, not the new and timely limited employment contracts.
Such termination designed to terminate must be void. This is in accordance to the existing opinion. Nevertheless, this situation is special compared to other terminations designed to terminate.
Second, the paper focuses on accidental collisions between general and special termination protection regulations.
It is not guaranteed, that an employee protected by special regulations automatically is more worthy of protection than an employee protected by general termination protection regulations.
The special quality triggering special protection does not naturally compensate a special social need for protection given by general termination protections.
But current law does not offer an option to compare the worthiness of protection.It also lacks of an scale or criteria to compare.
Furthermore to avoid disproportions in the individual case special termination regulations would have to be restricted. This proves to be almost impossible.
The same goes for any comparison in the individual case. Special qualities are difficult to be measured and due to their respective backgrounds they are most different and diverse.
Finally the paper offers a possible integrated system of general and special termination protection regarding terminations for operational reasons.
